ENM among cities opting out of state ordinance

The New Prague Times The Elko New Market City Council unanimously approved an amendment to opt out of a state ordinance concerning temporary family health care dwellings. With its action at its Thursday, July 28, meeting the council joined other Minnesota cities that are declining to participate in the ordinance.

The bill, approved by the state legislature this year, creates a process where landowners can place mobile residential dwellings on their property, which would serve as transitional housing for seniors and people with mental and physical disabilities. Under the law the temporary dwellings can be on a residential property for six months with an option to extend that for another six months. The property must belong to a relative or care giver of the person living in the temporary dwelling. The dwelling, which could be a recreational vehicle, would be allowed to be parked in a driveway or yard as long as it meets setback requirements.

City staff cited concerns with the ordinance, including those with zoning, whether the temporary dwelling would be consistent with the intent of Elko New Market’s single family residential districts; the temporary dwellings would not meet the city’s building code requirements and the dwellings may become permanent guest homes or family quarters.
