FILING NOTICE

TOWNSHIP OF CEDAR LAKE BOARD OF SUPERVISORS

Notice is hereby given to qualified voters of Cedar Lake Township, Scott County, State of Minnesota that filing for town offices will be held for a two week period beginning December 28, 2004.

Affidavits of Candidacy shall be filed with the Town Clerk, Arnita Novotny, at 27750 Teale Avenue, New Prague, MN 56071 between the hours of 8:00 a.m. to 5:00 p.m. from December 28, 2004 to January 11, 2005. For questions call (952) 758-4943.

Filing will close on January 11, 2005 at 5:00 p.m.

Filing fee $2.00

Offices to be filled at the March annual election are: One (1) Supervisor, for three (3) year term; One (1) Treasurer, for two (2) year term.

Notice of filing dates and offices for

annual election

Filings for the Annual Township election to be held on Tuesday, March 8, 2005 will be accepted for the following offices:

One (1) Supervisor for a 3 year term

One (1) Treasurer for a 2 year term.

Affidavits of candidacy will be accepted at the Clerk’s home/office, 23765 Texas Ave., Lakeville, MN 55044, Phone 952-461-3121, from Tuesday, December 28, 2004 until Tuesday, January 11, 2005. Filing hours are from 8:00 a.m. until 4:30 p.m. and Saturday January 8, 2005 from 8:00 a.m. until 12:00 p.m.

NOTICE OF MORTGAGE FORECLOSURE SALE

THE RIGHT TO VERIFICATION OF THE DEBT AND IDENTITY OF THE ORIGINAL CREDITOR WITHIN THE TIME PROVIDED BY LAW IS NOT AFFECTED BY THIS ACTION.

NOTICE IS HEREBY GIVEN: That default has occurred in the conditions of that certain mortgage dated January 25, 2002 executed by Randy M. Klotz and Peggy J. Klotz, husband and wife, as mortgagors, to Wells Fargo Home Mortgage, Inc., a California corporation, nka Wells Fargo Bank, N.A. successor by merger to Wells Fargo Home Mortgage, Inc., as mortgagee, and filed for record in the Office of the County Recorder, in and for the County of Le Sueur, Minnesota, on January 31, 2002 as Document No. 294836; the original principal amount secured by said mortgage being $92,000.00; that no action or proceeding has been instituted at law to recover the debt secured by said mortgage, or any part thereof; that there has been compliance with all pre-foreclosure notice and acceleration requirements of said mortgage, and/or applicable statutes; that there is claimed to be due upon said mortgage, including interest to the date hereof, the sum of NINETY FOUR THOUSAND THREE HUNDRED TEN and 85/100 ($94,310.85) DOLLARS and that pursuant to the power of sale therein contained, said mortgage will be foreclosed and the tract(s) of land lying and being in the County of Le Sueur, State of Minnesota, described as follows, to wit:

Lot Twenty (20), Block Fourteen (14), in the Village of Elysian, formerly called Logan, Le Sueur County, Minnesota

will be sold by the sheriff of said county at public auction to the highest bidder on February 10, 2005 at 10:00 A.M., at the main office of the Le Sueur County Sheriff, 130 South Park Avenue, Le Center, Minnesota, to pay the debt then secured by said mortgage and taxes, if any actually paid by the mortgagee, on the premises and the costs and disbursements allowed by law. The time allowed by law for redemption by said mortgagor(s), their personal representatives or assigns is six (6) months from the date of sale.

Mortgagors released from financial obligation on the mortgage: none.

THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGOR, THE MORTGAGOR'S PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
