ORDINANCE #187, NEW PRAGUE ZONING ORDINANCE

  NOTICE IS HEREBY GIVEN that a Public Hearing will be held before the New Prague Planning Commission on Wednesday, May 25th, 2005, at 6:30 P.M., or shortly thereafter at the New Prague City Hall to consider a proposed amendment to the New Prague Zoning Ordinance #187. A change is proposed to Section 711 for Accessory Buildings and Structures in residential districts which would amend the allowed height of access doors or openings from the currently allowed maximum height of 10' to be a maximum of 12'.

  NOTICE IS HEREBY GIVEN that a Public Hearing will be held before the New Prague Planning Commission on Wednesday, May 25, 2005, at 6:30 P.M., or shortly thereafter at the New Prague City Hall to consider proposed amendments to the New Prague Zoning Ordinance #187.  Proposed changes include adding Section 731 pertaining to Feedlot regulations. The proposed addition of Section 731 would recognize that feedlot operations exist around the perimeter of the city limits, to prevent the placing of new feedlots within the municipal city limits, to minimize land use conflicts by placing minimum setback requirements between feedlots and urban development, and to safeguard the public health, safety and general welfare of the citizens of New Prague.

32.01 PURPOSE

The City Council finds that it is in the interest of public safety to conduct criminal background checks on finalist for positions of employment.

32.02 CRIMINAL HISTORY BACKGROUND CHECKS AUTHORIZED.

The New Prague Police Department is authorized to conduct a MN computerized criminal history and driving record background investigation on applicants for positions with the City, as provided by this Section. This Section applies only to applicants who are finalist for positions with the City, where the City Administrator has determined that conviction of a crime may relate directly to the position sought. The Police Department may not perform a background investigation unless the applicant consents in writing to the investigation and to the release of the investigation information to the City Administrator and other staff as is appropriate. An applicant’s failure to provide consent may disqualify the applicant for the position sought. The background check will not be used for subsequent determinations about the individual; a new background check must be run, requiring consent of the individual.

32.03 REQUIRE DISCLOSURE

If the City rejects the applicant’s application due, solely or in part, to the applicant’s prior conviction of a crime, subject to the exception set forth in Minnesota Statutes, Section 364.09, the City Administrator must notify the applicant in writing of the following.

(1) The grounds and reasons for the rejection;

(2) The applicable compliant and grievance procedure set forth in Minnesota Statutes, Section 364.06;

(3) The earliest date the applicant may reapply for employment; and

(4) That all competent evidence of rehabilitation will be considered upon reapplication.

32.04 QUESTIONED IDENTITY

This section acknowledges that questioned identity situations may occur and the City will provide a process to allow for fingerprint verification in cases where it is not clear if a record based on a name and date of birth search actually belongs to the person.

32.05 POSITIONS AFFECTED.

This section shall apply to all positions within City departments, including those represented by a bargaining unit, full-time, part-time, seasonal, volunteer and paid on call, and also seasonal positions that are part of a joint powers agreement.

1.03 DEPOSIT

A. Contractors may obtain sets of documents through the printing company for a refundable deposit of $150 per set if a bonifide bid is submitted and documents are returned in good condition within ten (10) working days after the bid opening. Copies of documents will be available on or about May 26, 2005.

B. Upon request, sets will be mailed for a non-refundable $30 shipping & handling fee (check made out to Amcon CM, LLC) in addition to the refundable $150 deposit (check made out to Amcon CM, LLC)

1.04 REJECTION & BID AWARD

A. Owner reserves the right to reject any or all proposals and to waive informalities and irregularities in the bidding.

B. Owner/Contractor contract shall be standard AIA Agreement between Owner and Contractor, Construction Management Edition, AIA Document A101/CMa-1992.

C. Alternates may be selectively accepted or rejected in any order at the Owner’s discretion.

1.05 TIME OF AWARD

A. Contractor to hold all bids valid for sixty (60) days.
